Gifted vs paid creator collaborations

Define posting obligations, payment, disclosure, and content rights before sending a product.

A creator collaboration needs an explicit agreement about what each party gives and expects. "Gifted" and "paid" can hide different arrangements, especially when a brand offers product in exchange for a required post.

Describe the arrangement

An optional product gift leaves the creator free to decide whether to publish. Tell them this before they accept. Receiving a parcel should not trigger a surprise deadline or a demand for favorable coverage.

A product-for-content arrangement includes agreed work in exchange for product. Write down the deliverables and terms. The absence of a cash fee does not remove the work involved or settle the applicable legal obligations.

A paid collaboration includes a fee for agreed work. Product, expenses, usage rights, and paid amplification may need separate terms. State what the quoted amount covers.

Resolve these questions before acceptance

  • Is posting optional or required?
  • Which deliverables and dates apply?
  • What compensation and expenses will the brand cover?
  • Can the creator share an unfavorable experience?
  • What disclosures and content permissions are required?

For an illustrative offer, "We will send a bottle with no posting obligation" describes a different arrangement from "We offer product for one video by Friday." Do not use the first sentence while expecting the second arrangement.

Gifts and other material relationships can require disclosure under applicable rules. Check the requirements for the relevant market and platform. Agree on reuse rights separately, and put the final terms in writing before shipment.
